Customer Acceptance of Hosted Voice, SIP & Inbound Porting Authority Form

Acceptance of Authority to Transfer Telecommunications Services

This document confirms the Customer’s acceptance of the Hosted Voice, SIP & Inbound Customer Porting Authority Form – Customer Authority to Transfer Fixed Line Services to AUSTSERVE IT Pty Ltd (“Porting Authority Form”) issued by AUSTSERVE IT Pty Ltd (ABN 49 691 771 614) (“AUSTSERVE IT”).

By accepting this document, the Customer acknowledges, confirms and agrees that the Porting Authority Form has been reviewed, understood and accepted and forms part of the Customer’s agreement with AUSTSERVE IT.


1. Acceptance and Incorporation of Porting Authority Form

The Customer acknowledges and agrees that:

a. the Porting Authority Form, including all terms, conditions, authorities, acknowledgements and obligations contained within it, is incorporated into and forms part of this acceptance;

b. acceptance of this document confirms the Customer’s agreement to be bound by the Porting Authority Form without requiring completion of any additional customer information, service selections or fields contained within this acceptance document;

c. any customer details, nominated services, account selections, transfer requests or other information contained within the Porting Authority Form remain valid and are accepted by the Customer when this acceptance is provided;

d. this document operates as confirmation of acceptance of the Porting Authority Form and does not replace, amend or limit the terms contained within that form.


2. Appointment of AUSTSERVE IT as Authorised Agent

The Customer confirms and authorises the appointment of AUSTSERVE IT as its authorised agent in relation to the transfer, migration and ongoing management of the nominated telecommunications services identified in the Porting Authority Form.

The Customer authorises AUSTSERVE IT to:

a. communicate and correspond with the Customer’s existing carrier, service provider or any other telecommunications provider;

b. request the release, transfer, porting or migration of the nominated services;

c. select or nominate carriers, networks or service providers where required to provide the agreed services;

d. prepare, complete, submit, sign and process any documentation reasonably required by another carrier, service provider or telecommunications provider to facilitate the transfer of services.


3. Customer Authority and Representations

The Customer represents and warrants that:

a. the person providing acceptance of this document has full authority to act on behalf of the Customer and bind the Customer to these terms;

b. the Customer is authorised to request the transfer of the nominated telecommunications services;

c. all information supplied by or on behalf of the Customer in connection with the Porting Authority Form is true, accurate and complete;

d. the Customer accepts responsibility for all obligations arising from the transfer and ongoing provision of services by AUSTSERVE IT.


4. Service Transfer and Ongoing Obligations

The Customer acknowledges and agrees that:

a. AUSTSERVE IT will request the Customer’s current service provider to release and transfer the nominated services to AUSTSERVE IT and/or any carrier nominated by AUSTSERVE IT;

b. the nominated services will remain active with the existing service provider until the transfer becomes effective;

c. unless otherwise agreed, transferred services will retain their current configuration, features, barring arrangements and calling number display settings;

d. the Customer may lose any incentives, discounts, benefits or arrangements provided by the existing service provider following completion of the transfer;

e. the Customer remains responsible for contacting the existing service provider regarding faults, service enquiries or support matters until the transfer is completed;

f. AUSTSERVE IT will become the Customer’s service provider for the transferred services once the transfer is effective, regardless of any underlying carrier or network provider used to deliver those services.


5. Charges and Liability

The Customer acknowledges and agrees that:

a. the Customer remains responsible for all charges incurred in relation to the nominated services up to the effective date of transfer;

b. any outstanding, unbilled or transferred charges from the Customer’s existing service provider may be handled in accordance with applicable telecommunications industry processes and may be invoiced through AUSTSERVE IT where applicable;

c. the Customer is solely responsible to AUSTSERVE IT for all charges incurred from the effective date of transfer;

d. the Customer indemnifies and holds harmless AUSTSERVE IT against any loss, damage, claim, proceeding, liability or cost (including legal costs on an indemnity basis) arising from incorrect, incomplete or misleading information provided by or on behalf of the Customer in connection with the Porting Authority Form or any related documentation.


6. Cancellation of Authority

The Customer acknowledges that the appointment of AUSTSERVE IT as authorised representative for the nominated services may only be cancelled in accordance with the applicable AUSTSERVE IT Services Agreement and/or Service Schedule.


7. Electronic Acceptance and Execution

The Customer agrees that acceptance of this document by any electronic method, including:

  • selecting an acceptance checkbox;
  • approving an electronic application or order;
  • clicking an acceptance button;
  • providing electronic confirmation; or
  • any other authorised digital acceptance method,

constitutes valid acceptance and execution of this document.

Such acceptance has the same legal effect as a handwritten signature and confirms the Customer’s intention to be legally bound by this document and the Porting Authority Form.


8. Confirmation of Acceptance

By selecting acceptance of this document, the Customer confirms that:

☒ The Customer accepts the Hosted Voice, SIP & Inbound Customer Porting Authority Form and authorises AUSTSERVE IT Pty Ltd to proceed with the transfer of the nominated telecommunications services.

The person providing acceptance confirms they are authorised to accept these terms on behalf of the Customer.
